(3)License

A.) General use

Under the condition that you continue to abide by the terms of this License, ENZA™ hereby grants you a non-exclusive, non-transferable, worldwide license to use, reproduce, and display the Art for your Purchased NFTs, together with any Extensions you may elect to develop or use, solely for the following objectives:

(i) for your own private, non-commercial use

(ii) as a component of a marketplace that allows the purchase and sale of your NFTs, provided that the marketplace cryptographically verifies each NFT owner's right to display the Art for their Purchased NFTs to ensure that only the real owner can display the Art

(iii) as a component of a third-party website or application that allows the inclusion, involvement, or participation of your NFTs, provided that the Art for their Purchased NFTs may only be displayed by the real owner and so that it disappears once the owner of the Purchased NFT exits the website/application.

B.) Commercial Use.

To the extent that you continue to abide by the terms of this License, ENZA™ hereby grants you a limited, worldwide, non-exclusive, non-transferable license to use, copy, and display the Art for your Purchased NFTs for the purpose of commercializing your own goods that incorporate, contain, or consist of the Art for your Purchased NFTs ("Commercial Use"). However, such Commercial Use may not cause you to receive more than $100,000 in gross sales. Upon reaching $100,000 in gross sales you are entered into a revenue sharing agreement with ENZA™. 5% of all profits exceeding the initial $100,000 is to be given to ENZA™. Failure to comply with our policy will result in a 10% fine on all revenue exceeding the $100,000 limit. Failure to pay will result in immediate legal action.

Nothing in this Section 3.B shall be construed as preventing you from: (i) owning or operating a marketplace that generally allows the use and sale of NFTs, provided that the marketplace cryptographically verifies each NFT owner's right to display the Art for their Purchased NFTs to ensure that only the actual owner may display the Art; (ii) owning or running a third-party website or application that allows NFTs to be included, involved, or participated in generally, provided that the third-party website or application cryptographically confirms each NFT owner's rights to display the Art for their Purchased NFTs to ensure that only the actual owner can display the Art, and provided that the Art is hidden once the owner of the Purchased NFT leaves the website/application; or (iii) earning money through NFTs, even where such revenue is in excess of $100,000 per year.
